This is an action for damages under the Federal Employers Liability Act. Plaintiff brakeman sued defendant railroad for injuries he received in a switching accident. The district court, Cascade County, granted plaintiff a partial summary judgment on the issue of liability. The issue of the amount of plaintiffs damages was tried to a jury which returned an 8 to 4 verdict for $525,000. Following entry of judgment thereon and denial of defendants motion for a new trial, defendant appeals.
